TERMS & CONDITIONS

By engaging in the services of Escape To Recharge LLC ("Agency"), the traveler(s) ("Client") acknowledges that they have read, understand, and agree to these Terms & Conditions.

Escape To Recharge LLC acts as an independent travel advisor and arranges travel services through third-party travel suppliers.


2. CLIENT INQUIRY & PLANNING PROCESS

Escape To Recharge LLC provides customized travel planning services. To begin the planning process, all prospective clients must complete a Travel Inquiry Form. Clients may complete the inquiry form independently or schedule a consultation call for assistance.

Prior to submitting an inquiry, clients should have a general understanding of their preferred:

• Destination(s)
• Travel dates or date range
• Budget
• Travel style and preferences
• Desired travel experience

Upon receipt of the inquiry form, Escape To Recharge LLC will review the requested travel project and determine whether it is a project the Agency is able to accommodate.

Clients will be notified of the Agency's decision within approximately 24 business hours. If the project is accepted, the Agency will provide:

• A recap of the client's travel preferences and requirements
• An estimated timeline for completion of research and delivery of travel quotes or proposals

Travel planning timelines vary based on destination complexity, group size, supplier response times, and travel requirements.

If a client requests significant changes after a quote or proposal has been provided, including but not limited to changes in destination, travel dates, budget, resort type, cruise line, room category, travel experience, or group composition, Escape To Recharge LLC reserves the right to:

• Request additional research time
• Assess additional planning or research fees
• Decline further work on the project
• Refer the client to another travel advisor

Acceptance of a project does not guarantee availability, pricing, or confirmation of travel arrangements.


3. COMMUNICATION POLICY

Email is the primary method of communication for Escape To Recharge LLC. All quotes, proposals, invoices, confirmations, travel documents, payment reminders, and important travel information will be sent via email.

Clients are responsible for:

• Providing a valid email address
• Monitoring their email inbox and spam/junk folders
• Reviewing communications in a timely manner
• Responding to requests for information when necessary

Failure to review or respond to email communications may result in missed deadlines, supplier penalties, cancellation of reservations, or forfeiture of funds.

Clients may schedule phone consultations when needed. Phone calls are available by appointment only unless otherwise agreed upon.

As a courtesy, clients may elect to receive text message notifications when important emails are sent. Text messages are intended solely as reminders and notifications and should not be relied upon as the primary method of communication.

By opting into text messaging, the client acknowledges:

• Standard messaging and data rates may apply.
• Message delivery is not guaranteed.
• Text notifications do not replace the client's responsibility to review email communications.

Escape To Recharge LLC reserves the right to discontinue text message communications at any time and may continue to communicate exclusively through email when necessary.


4. BOOKING AUTHORIZATION

By requesting travel services, Client authorizes Escape To Recharge LLC to research, quote, reserve, and arrange travel services on their behalf.

Client is responsible for reviewing all itineraries, invoices, travel documents, confirmations, names, dates, and pricing for accuracy upon receipt. Any discrepancies must be reported immediately.

Escape To Recharge LLC is not responsible for errors that are not promptly reported by Client.


5. PRICING & AVAILABILITY

All pricing and availability are subject to change until reservations are confirmed and payment has been processed.

Quotes are not guaranteed until booked and deposited. Travel suppliers may modify pricing, taxes, fees, fuel surcharges, resort fees, and other charges without prior notice.


6. DEPOSITS & PAYMENTS

Deposit amounts, payment schedules, and final payment deadlines are determined by the travel supplier unless otherwise specified.

Failure to make payments by the supplier's due date may result in cancellation of reservations and forfeiture of monies previously paid.

Accepted payment methods include major credit cards, debit cards, and other approved payment methods.

Submission of a payment authorization form constitutes authorization for Escape To Recharge LLC and/or the travel supplier to process approved charges.


7. AGENCY FEES

Research fees, consultation fees, itinerary planning fees, sustainable travel fees, change fees, and other service fees charged by Escape To Recharge LLC are non-refundable once services have been rendered.

Agency fees are separate from supplier fees and cancellation penalties.


8. CANCELLATIONS & REFUNDS

Supplier cancellation policies apply to all reservations.

Refund eligibility, penalties, and timelines are determined solely by the travel supplier.

Escape To Recharge LLC does not control supplier refund processing times and cannot guarantee refunds.

Unused travel services are generally non-refundable.


9. TRAVEL PROTECTION

Travel protection is strongly recommended for all travelers.

Travel protection may provide coverage for trip cancellation, interruption, delays, medical emergencies, emergency evacuation, baggage loss, and other unforeseen events.

By declining travel protection, Client acknowledges responsibility for cancellation penalties, medical expenses, supplier default, weather-related disruptions, and travel interruptions.


10. PASSPORTS, VISAS & TRAVEL REQUIREMENTS

Travelers are solely responsible for obtaining and maintaining:

• Valid passports

• Required visas

• Entry permits

• Vaccinations

• Customs documentation

• Health documentation

• Any other travel requirements imposed by destinations or suppliers

Escape To Recharge LLC is not responsible for denied boarding, denied entry, or additional costs resulting from insufficient travel documentation.


11. HEALTH & MEDICAL RESPONSIBILITY

Travelers are responsible for determining their fitness to travel and for consulting medical professionals regarding vaccinations, medications, and health-related travel concerns.

Travelers with medical conditions, disabilities, dietary restrictions, or special needs must notify the Agency prior to booking.


12. SUPPLIER RESPONSIBILITY DISCLAIMER

Escape To Recharge LLC acts solely as an intermediary between Client and independent travel suppliers, including but not limited to airlines, hotels, cruise lines, resorts, transportation providers, tour operators, and travel insurance providers.

Escape To Recharge LLC is not responsible for acts, omissions, negligence, bankruptcy, financial default, service interruptions, delays, cancellations, overbookings, injuries, damages, or losses caused by any travel supplier.


13. FORCE MAJEURE

Escape To Recharge LLC shall not be liable for any delay, cancellation, loss, injury, or expense resulting from circumstances beyond its control, including but not limited to:

• Hurricanes

• Tropical storms

• Severe weather

• Natural disasters

• Acts of God

• Pandemics

• Epidemics

• Government actions

• Travel restrictions

• Civil unrest

• Terrorism

• Labor strikes

• Mechanical failures

• Supplier insolvency

No refunds are guaranteed for force majeure events unless provided by the supplier or travel protection policy.


14. HURRICANE & WEATHER DISCLAIMER

Travel to tropical and coastal destinations may be impacted by hurricanes, tropical storms, and severe weather.

Travelers acknowledge these risks and are encouraged to purchase travel protection.

Escape To Recharge LLC is not responsible for weather-related disruptions, itinerary changes, or associated expenses.


15. FLIGHT SCHEDULE CHANGES

Airlines may modify schedules, routes, aircraft, or seating assignments at any time.

Clients are responsible for monitoring airline notifications and flight schedules.

Additional expenses resulting from airline schedule changes are the responsibility of the traveler.


16. CRUISE-SPECIFIC TERMS

Cruise itineraries, ports of call, embarkation schedules, and onboard activities are subject to change at the cruise line's discretion.

Port cancellations, itinerary modifications, and delays may occur without compensation.

Gratuities, taxes, government fees, and port charges may increase prior to departure.

Travelers remain responsible for obtaining proper travel documentation.


17. GROUP TRAVEL TERMS

Group reservations, destination weddings, reunions, and other group travel arrangements may require minimum participation levels.

Room blocks, group amenities, and pricing may be impacted if participation requirements are not met.

Individual travelers remain subject to supplier cancellation penalties regardless of group status.

Group leaders are not financially responsible for other travelers unless specifically agreed upon in writing.


18. CHARGEBACK POLICY

Client acknowledges that all authorized charges, supplier penalties, non-refundable deposits, agency service fees, and travel arrangements are valid charges.

Client agrees not to initiate chargebacks for properly authorized transactions.

Any chargeback initiated for valid charges may result in collection efforts and recovery of attorney fees, court costs, and related expenses where permitted by law.


19. ELECTRONIC SIGNATURES & COMMUNICATIONS

Electronic signatures, electronic approvals, and electronic payment authorizations shall have the same legal effect as handwritten signatures.

Email communications, online forms, and electronic messages constitute written notice.


20. EMERGENCY ASSISTANCE DISCLAIMER

Escape To Recharge LLC is not an emergency response provider.

Travelers experiencing urgent travel issues should first contact the airline, cruise line, hotel, tour operator, travel protection provider, or local emergency services.


21. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Escape To Recharge LLC shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from travel arrangements or services provided by third-party suppliers.

Any liability of Escape To Recharge LLC shall be limited to the amount of agency fees paid by Client.


22. GOVERNING LAW & VENUE

These Terms & Conditions shall be governed by the laws of the State of Florida.

Any dispute arising under these Terms & Conditions shall be exclusively resolved in the state or federal courts located in Orange County, Florida.
